• • Attempting to bypass security measures or access restricted areas
• • Transmitting viruses, malware, or any other malicious code
• • Harassing, threatening, or defaming other users or third parties
• • Impersonating any person or entity or misrepresenting your affiliation
• • Using services for any commercial purposes without our express permission

3. Content Guidelines

Any content you submit through our services must not contain illegal material, infringe on intellectual property rights, contain malicious code, violate privacy rights, or be defamatory, obscene, or offensive. We reserve the right to remove any content that violates these guidelines without notice.

4. Age Restrictions

Our services are intended for users aged 18 years and older. By using our services, you represent and warrant that you are at least 18 years of age. We do not knowingly collect information from or direct services to individuals under 18.

5. Compliance with Laws

You are solely responsible for ensuring that your use of our services complies with all applicable local, state, national, and international laws and regulations. This includes but is not limited to laws regarding data protection, export control, and intellectual property. You agree to indemnify QuantumBit against any claims arising from your non-compliance.

6. Indemnification

You agree to indemnify, defend, and hold harmless QuantumBit, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the services, your violation of these Terms and Conditions, or your violation of any rights of another party.

7. Privacy and Data Protection

You acknowledge that you have read and understood our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our services, you consent to our collection and use of your data as described in the Privacy Policy. You are responsible for maintaining the privacy of any data you share through our services.

8. Third-Party Interactions

Your interactions with third-party services, websites, or organizations found through our services are solely between you and the third party. QuantumBit is not responsible for any loss or damage arising from such interactions. You acknowledge that we do not endorse any third-party services or content.

9. Disclaimer of Warranties

QuantumBit provides services on an "as is" and "as available" basis. We make no warranties, expressed or implied, including but not limited to:

• • Warranties of merchantability or fitness for a particular purpose
• • Warranties regarding accuracy, reliability, or completeness of content
• • Warranties that services will be uninterrupted, secure, or error-free
• • Warranties regarding results or outcomes from using our services

10. Limitation of Liability

To the fullest extent permitted by applicable law, QuantumBit shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from your use of or inability to use the services, even if we have been advised of the possibility of such damages.

11. Maximum Liability Cap

In no event shall QuantumBit's total liability to you for all damages, losses, and causes of action exceed the amount paid by you to QuantumBit in the twelve months preceding the claim, or ¥10,000 (whichever is greater).

12. Force Majeure

QuantumBit shall not be liable for any failure to perform its obligations where such failure results from circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, natural disasters, pandemics, government actions, internet failures, or telecommunications infrastructure failures.

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of, without giving effect to any principles of conflicts of law. You agree to submit to the personal and exclusive jurisdiction of the courts located in Tokyo.

14. Dispute Resolution

Any disputes arising out of or relating to these Terms and Conditions or your use of our services shall first be attempted to be resolved through good-faith negotiations between the parties. If negotiations fail, disputes shall be resolved through binding arbitration in Tokyo, in accordance with the rules of the Commercial Arbitration Association, except where prohibited by law.

15. Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Severability

If any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions. The unenforceable provision shall be modified to reflect the parties' intention as closely as possible.

17. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any other legal notices published by QuantumBit, constitute the entire agreement between you and QuantumBit concerning your use of the services. These Terms supersede all prior or contemporaneous communications and proposals.

18. Waiver

No waiver of any term of these Terms and Conditions shall be deemed a further or continuing waiver of such term or any other term. QuantumBit's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
